Please read these Terms and Conditions carefully before using the Jaldhara platform, website, or mobile application. By accessing or using our services, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, please discontinue use immediately.
Welcome to Jaldhara, a technology-based hyperlocal water delivery subscription platform operated from Jaipur, Rajasthan, India. Jaldhara connects consumers who require water cans or jars ("Customers") with local water suppliers ("Suppliers") operating in the same geographic region.
These Terms and Conditions ("Terms") constitute a legally binding agreement between Jaldhara ("Platform", "We", "Us", "Our") and every person or entity that accesses, registers on, or uses the Jaldhara platform, including both Customers and Suppliers.
By completing registration, subscribing to any delivery plan, listing your services, accepting an order, or making a payment through the Platform, you unconditionally accept these Terms in their entirety.
Jaldhara reserves the right to update or modify these Terms at any time. Continued use of the Platform following notification of changes constitutes acceptance of the revised Terms.
The following terms, when used in this document, shall have the meanings set out below:

| Order | A confirmed delivery request generated by the Platform when a Supplier accepts a Customer subscription request. |
| Settlement | The periodic transfer of earnings from Jaldhara to a Supplier, conducted on a weekly or bi-weekly basis. |
| Margin | The difference between the retail price displayed to the Customer and the contracted supply price agreed with the Supplier. |
| Grievance Officer | The designated individual at Jaldhara responsible for receiving and resolving user complaints under IT Rules 2021. |
| Force Majeure | Events beyond reasonable control, including natural disasters, government orders, pandemics, or infrastructure failures. |
| DPDP Act | The Digital Personal Data Protection Act, 2023, the primary data protection law applicable to Jaldhara's operations. |
Jaldhara is a technology intermediary platform. We do not manufacture, store, own, or physically deliver any water products. Our role is limited to providing the digital infrastructure that facilitates connections between Customers and Suppliers.
The Platform provides the following services:
Jaldhara currently operates within Jaipur, Rajasthan, India. Services are available only in localities where registered Suppliers are active. The Platform does not guarantee service availability in every pin code or area within the city. Availability is subject to Supplier presence in your delivery zone.
Jaldhara functions as an intermediary under the Information Technology Act, 2000 and IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. Notwithstanding this status, Jaldhara has voluntarily assumed responsibility for service delivery outcomes as detailed in Section 9 of these Terms.
You must be at least 18 years of age and legally capable of entering into a binding contract under the Indian Contract Act, 1872 to register as a Customer on the Platform.
To access Platform services, Customers must provide the following accurate and complete information:
You are responsible for maintaining the confidentiality of your account credentials. Any activity conducted through your account will be deemed to have been authorised by you. Notify Jaldhara immediately at [email protected] if you suspect unauthorised access to your account.
As a Customer, you agree to:
Both registered businesses and individual water delivery service providers may register as Suppliers. By registering, Suppliers represent and warrant that they operate lawfully and comply with all applicable local regulations, health and safety standards, and licensing requirements applicable to their business.

By completing registration and accepting orders on Jaldhara, every Supplier unconditionally declares and warrants that:
Jaldhara does not independently verify Supplier licenses. Any misrepresentation constitutes a material breach of these Terms and may result in immediate account suspension, liability for damages, and reporting to regulatory authorities.
When a Customer subscription request is created in a Supplier's delivery zone, all eligible Suppliers will receive a notification. The first Supplier to accept the request will be assigned the order. By accepting an order, the Supplier commits to fulfilling every scheduled delivery on the agreed dates and times.

Customers may subscribe to the following water delivery frequencies:
A subscription becomes active only after: (a) the Customer has selected a delivery plan and quantity, (b) the Wallet has been funded with a minimum of five (5) days' delivery value, and (c) a Supplier in the Customer's zone has accepted the subscription request. Jaldhara does not guarantee that a Supplier will accept every subscription request, particularly in areas with limited Supplier presence.
Orders are generated automatically by the Platform each evening for the following day's delivery. The order amount is deducted from the Customer's Wallet at the time of order generation. If the Wallet balance is insufficient at the time of deduction, the order will not be placed and the delivery will not occur.
Customers may modify delivery schedules, quantities, or delivery addresses through the Platform. Changes made before the daily order generation time (as specified in the application) will take effect from the next delivery day. Changes made after order generation will take effect from the day following the next scheduled delivery.
Customers may pause an active subscription at any time through the Platform. Pausing will stop order generation from the next business day. Wallet balance is retained during a pause and will be applied to future orders when the subscription is resumed.
Jaldhara operates on a prepaid wallet system. Customers are required to maintain a minimum wallet balance equivalent to five (5) days' delivery value. The Platform will deduct the cost of each day's delivery from the Wallet on the evening preceding the delivery date.
The Platform will issue automated alerts via push notification, SMS, or email when the Customer's Wallet balance falls below the equivalent of two (2) days' delivery value. If the Wallet is not recharged and the balance falls to zero, the active subscription will be automatically paused. No deliveries will be made until the Wallet is recharged and the subscription is reactivated.
Customers may add funds to their Wallet at any time using PhonePe or other payment methods made available on the Platform. All transactions are processed securely through our payment gateway partner. Jaldhara does not store full payment card or UPI credentials on its servers.
Prices displayed to Customers on the Platform are set by Jaldhara independently and represent Jaldhara's retail pricing. These prices may differ from the contracted supply price agreed between Jaldhara and individual Suppliers. Suppliers receive only the contracted supply amount; the difference constitutes Jaldhara's platform margin. All prices are inclusive of applicable taxes unless stated otherwise.
Refund Policy Summary
Jaldhara will settle Supplier earnings on a weekly or bi-weekly cycle, as communicated during onboarding. Settlements will be transferred directly to the Supplier's registered bank account after deducting the applicable platform margin. Suppliers will receive a settlement statement with each payment. Jaldhara reserves the right to withhold settlement amounts that are subject to active Customer disputes.
Suppliers who are registered under the Goods and Services Tax (GST) Act are responsible for issuing GST-compliant invoices to Jaldhara for their supply transactions. Jaldhara, as the marketplace operator, may have Tax Collected at Source (TCS) obligations under applicable GST provisions. Customers and Suppliers are advised to consult a qualified Chartered Accountant for guidance on their individual tax obligations.
Jaldhara is committed to protecting the personal data of all users. Our data collection, processing, and storage practices are governed by the Digital Personal Data Protection Act, 2023 (DPDP Act) and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.
Jaldhara collects the following categories of personal data:
Collected data is used exclusively for: subscription and order management, Supplier matching, payment processing, customer support, service improvement, and regulatory compliance. Jaldhara does not sell personal data to third parties.
Jaldhara shares data with PhonePe (payment processing) and other essential service providers solely for the purpose of delivering Platform services. All third-party processors are contractually bound to data protection obligations consistent with the DPDP Act.
Under the DPDP Act, you have the right to access, correct, and request erasure of your personal data. To exercise these rights, contact our Grievance Officer at the details provided in Section 13.
All intellectual property on the Jaldhara Platform, including but not limited to the brand name, logo, platform design, user interface, technology infrastructure, software, databases, algorithms, and written content, is the exclusive property of Jaldhara or its licensors.
Users are granted a limited, non-exclusive, non-transferable licence to access and use the Platform solely for its intended purposes. Nothing in these Terms shall be construed as transferring any intellectual property rights to any user. Unauthorised reproduction, distribution, modification, or commercial use of any Platform content is strictly prohibited.
Any feedback, suggestions, or content submitted by users to Jaldhara may be used by Jaldhara freely without obligation, compensation, or attribution.
Notwithstanding its role as a technology intermediary, Jaldhara assumes operational responsibility for ensuring that confirmed orders are fulfilled. If a Supplier who has accepted an order fails to deliver, Jaldhara will endeavour to arrange delivery through an alternate Supplier or issue a credit to the Customer's Wallet equivalent to the undelivered order value.
Important Disclaimer — Water Quality:
Jaldhara does not independently test, verify, or certify the quality of water products supplied by registered Suppliers. While Suppliers are contractually required to deliver safe and hygienic products, Jaldhara cannot guarantee the water quality of any specific delivery.
Customers are advised to exercise their own judgment regarding the suitability of delivered water products. For health-critical use, we recommend independent quality verification.
Jaldhara's liability in relation to water quality issues shall be limited to facilitating dispute resolution and, where appropriate, issuing Wallet credits for disputed deliveries.
To the maximum extent permitted by applicable law, Jaldhara's aggregate liability to any Customer or Supplier arising from or in connection with these Terms, any order, or any Platform service shall not exceed the total value of the specific order(s) in dispute in the preceding thirty (30) days.
Jaldhara shall not be liable for: indirect, consequential, or incidental losses; loss of profit or business opportunity; personal injury or property damage caused by delivered products (beyond the delivery value); or losses arising from Force Majeure events.
Jaldhara strives for continuous Platform availability but does not guarantee uninterrupted access. Scheduled maintenance, technical failures, or third-party outages may temporarily affect services. Jaldhara shall not be liable for losses resulting from Platform downtime.
The following conduct is strictly prohibited on the Jaldhara Platform:
Breach of this Section may result in immediate account suspension, termination, forfeiture of pending settlements, and reporting to relevant law enforcement or regulatory authorities.
Customers may close their account at any time through the Platform settings. Upon account closure, active subscriptions will be cancelled, pending orders will be handled per the Refund Policy, and unused Wallet balance will be refunded within 7 business days.
Suppliers may deregister from the Platform by providing a minimum of 14 days' written notice to Jaldhara. Suppliers must fulfil all accepted orders during the notice period. Outstanding settlements will be processed at the next regular settlement cycle following the notice period.
Jaldhara reserves the right to suspend or permanently terminate any user account with or without notice in the event of: violation of these Terms; fraudulent, abusive, or unlawful conduct; non-fulfilment of accepted orders (Suppliers); persistent low Wallet balance (Customers); or any conduct that Jaldhara reasonably believes poses a risk to other users or the Platform.
Upon termination, all licences granted under these Terms cease immediately. Clauses relating to data privacy, intellectual property, liability, and dispute resolution shall survive termination.
In the event of any dispute, complaint, or grievance, users must first contact Jaldhara's Grievance Officer (details in Section 14). Jaldhara will endeavour to resolve all complaints within 30 days of receipt, in accordance with IT Rules 2021 requirements.
If a dispute cannot be resolved through internal escalation within 45 days, the parties agree to resolve the matter through binding arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Jaipur, Rajasthan. Proceedings shall be conducted in English. The arbitral award shall be final and binding on both parties.
These Terms shall be governed by and construed in accordance with the laws of India. Subject to the arbitration clause above, the courts of Jaipur, Rajasthan shall have exclusive jurisdiction over any disputes that are not subject to arbitration.
Nothing in these Terms shall limit a Customer's right to approach the Consumer Disputes Redressal Forum under the Consumer Protection Act, 2019, or any other statutory right available to consumers under Indian law.
Jaldhara reserves the right to amend, update, or replace these Terms at any time. In the event of material changes, Jaldhara will notify registered users via email, push notification, or an in-app banner at least 7 days prior to the changes taking effect.
Your continued use of the Platform following the effective date of any amendments constitutes your acceptance of the revised Terms. If you do not agree with the amended Terms, you must stop using the Platform and close your account before the effective date.
The most current version of these Terms will always be available on the Jaldhara website and mobile application. It is your responsibility to review the Terms periodically.
Jaldhara shall not be held liable for any failure or delay in performance of its obligations where such failure or delay is caused by events beyond its reasonable control, including natural disasters, floods, epidemics, government orders, riots, power outages, cyberattacks, or failures of third-party infrastructure providers.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be severed from the Terms without affecting the validity or enforceability of the remaining provisions.
These Terms, together with the Privacy Policy, Refund Policy, and any other policies published on the Platform, constitute the entire agreement between the parties with respect to the use of the Jaldhara Platform and supersede all prior discussions, representations, or agreements.
Failure by Jaldhara to enforce any provision of these Terms on any occasion shall not constitute a waiver of that right or provision in the future.
Nothing in these Terms creates any partnership, joint venture, employment, agency, or franchise relationship between Jaldhara and any Supplier. Suppliers are independent service providers solely responsible for their own business operations, labour practices, and legal compliance.
As required under Rule 3(2) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, Jaldhara has designated a Grievance Officer to receive and resolve complaints from users.
